These Terms & Conditions (“Terms”) apply to all photography, videography and related creative services provided by TC Creative (“TC Creative”, “we”, “us” or “our”).
By making a booking, paying an invoice, accepting a quotation or engaging TC Creative to provide services, you (“the Client”, “you” or “your”) acknowledge that you have read, understood and agreed to these Terms.
These Terms should be read together with the TC Creative Privacy Policy and Refund & Cancellation Policy.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law or other applicable legislation.
1. Services
TC Creative provides professional photography, videography and related creative services.
Services may include, but are not limited to:

Event photography

Event videography
-
Commercial photography
-
Commercial videography
-
Brand content
-
Social media content
-
Promotional content
-
Product photography and video
-
Corporate photography and video
-
Editing and post-production
-
Video production
-
Digital image and video delivery
-
Other creative services agreed between TC Creative and the Client
The specific services to be provided will be outlined in the applicable quotation, proposal, booking confirmation, invoice or written agreement.
2. Booking and Confirmation
A booking is only confirmed once:
-
The Client has accepted the applicable quotation or proposal; and
-
Payment has been made in full.
Payment in full secures the agreed date and services.
TC Creative may decline other enquiries or bookings for the same date once a booking has been confirmed.
A verbal enquiry, provisional date or quotation does not guarantee availability until the booking has been confirmed and payment has been received.
3. Payment
Payment must be made in full to secure the booking.
Unless otherwise agreed in writing, all invoices must be paid by the due date specified on the invoice.
TC Creative reserves the right not to commence services, attend an event or deliver final materials where payment has not been received as required.
Additional services, hours, equipment, travel, editing or other work outside the original agreed scope may incur additional charges.
4. Quotes and Scope of Work
Quotes and proposals are based on the information available to TC Creative at the time they are prepared.
The Client is responsible for ensuring that the information supplied to TC Creative regarding the event or project is accurate and complete.
Unless otherwise stated, a quotation applies only to the services specifically described in that quotation.
Any changes to the scope of work may result in additional fees.
Changes may include:

Additional shooting hours
-
Additional locations
-
Additional photographers or videographers
-
Additional equipment
-
Additional editing
-
Additional deliverables
-
Additional travel
-
Changes to the production requirements
-
Rush or expedited delivery
-
Additional revisions
Additional work will be discussed with the Client where reasonably possible before the additional costs are incurred.
5. Event Timing and Coverage
The Client is responsible for providing TC Creative with accurate event details, including:

Event commencement time
-
Event finish time
-
Venue details
-
Access requirements
-
Key activities or moments
-
Relevant schedules
-
Contact information for the event organiser
-
Parking or loading information where applicable
-
Any venue-specific requirements
TC Creative will make reasonable efforts to capture the agreed content within the booked coverage period.
TC Creative cannot guarantee that every individual, moment, activity or detail will be photographed or filmed.
Where an event runs beyond the agreed coverage period, additional coverage may be available subject to photographer/videographer availability and additional fees.
6. Client Responsibilities
The Client is responsible for:

Providing accurate project information

Providing reasonable access to the event or location

Obtaining any necessary venue permissions
-
Obtaining necessary permissions or consents from participants where required
-
Providing suitable access, lighting and working conditions where applicable
-
Informing TC Creative of any relevant restrictions
-
Ensuring that requested locations are accessible
-
Providing required materials or information within agreed timeframes
-
Providing reasonable cooperation during production
-
Ensuring that the event can be safely and reasonably filmed or photographed
TC Creative is not responsible for missed content resulting from circumstances caused by the Client, venue, guests, participants or other third parties.
7. Photography and Videography Style
The Client acknowledges that photography and videography are creative services.
The Client may review TC Creative's portfolio and previous work before booking and understands that the final work will reflect TC Creative's professional style, creative judgement and artistic approach.
The Client acknowledges that:

Lighting conditions can affect the final result;
-
Weather can affect outdoor photography and video;
-
Venue restrictions can affect the available shots;
-
Guest or participant behaviour is outside TC Creative's control;
-
The timing of an event may affect the content captured;
-
Final images and video may vary from examples shown in promotional material.
TC Creative retains creative discretion regarding composition, camera angles, lighting, editing, colour grading, music selection, sequencing and other creative decisions unless otherwise agreed in writing.
8. Image and Video Selection
Where TC Creative is responsible for selecting the final photographs or video content, TC Creative will use its professional judgement to determine which material is suitable for delivery.
Not every photograph or video file captured during a project will necessarily be supplied.
This may include material that is:

Duplicated
-
Out of focus
-
Technically unsuitable
-
Blurred
-
Poorly exposed
-
Unflattering
-
Test footage
-
Behind-the-scenes material
-
Unusable due to technical or environmental circumstances
The Client acknowledges that raw, unedited or rejected material is not automatically included in the final deliverables.
9. Editing and Post-Production
TC Creative will edit the agreed deliverables according to the style and specifications outlined in the booking or quotation.
Editing may include:

Colour correction
-
Colour grading
-
Exposure adjustments
-
Cropping
-
Retouching
-
Audio adjustments
-
Video editing
-
Transitions
-
Music
-
Graphics
-
Titles
-
Other post-production techniques
The extent of editing will depend on the package or services purchased.
Additional editing or substantial revisions outside the agreed scope may incur additional charges.
10. Revisions
Where revisions are included in the agreed package, they must be requested within a reasonable period following delivery.
Revision requests must relate to the agreed scope of the original project.
Requests for a completely different creative direction, substantial re-editing or additional deliverables may incur additional fees.
11. Delivery of Files
Final photographs and/or video files will be delivered using the agreed delivery method.
Delivery times will vary depending on the nature and scale of the project.
TC Creative will provide an estimated delivery timeframe where reasonably possible.
Delivery times may be affected by:

Project size
-
Editing requirements
-
Client delays
-
Revision requests
-
Technical issues
-
Third-party services
-
Unforeseen circumstances
TC Creative will make reasonable efforts to meet agreed delivery timeframes.
12. File Storage and Backups
TC Creative may retain project files for a reasonable period following delivery.
However, TC Creative does not guarantee permanent storage or archival of photographs, video footage or project files.
Once final files have been delivered, the Client is responsible for downloading and securely storing their own copies.
TC Creative is not responsible for loss of files after delivery where the loss results from the Client failing to download or maintain their own backup copies.
13. Raw Files
Unless expressly stated in writing, RAW photographs, unedited photographs, original camera files, project files and unedited video footage are not included in the agreed deliverables.
TC Creative retains ownership of its original working files unless otherwise agreed in writing.
Requests for RAW or unedited files may be considered separately and may incur additional fees.
14. Intellectual Property
Unless otherwise agreed in writing, TC Creative retains copyright and intellectual property rights in the photographs, video footage, edited works, creative concepts, production materials and other original creative works produced by TC Creative.
Payment for photography or videography services does not automatically transfer copyright ownership to the Client.
The Client receives a licence to use the final delivered material for the purposes and platforms agreed as part of the booking.
Any broader commercial, advertising, resale, licensing or third-party use may require additional permission or licensing.
15. Client-Supplied Materials
Where the Client supplies photographs, logos, music, video, graphics, trademarks, documents or other materials to TC Creative, the Client confirms that they have the necessary rights and permissions to provide and use those materials.
The Client grants TC Creative permission to use those materials for the purpose of providing the agreed services.
The Client is responsible for any claims arising from materials supplied by the Client where the Client did not have the necessary rights or permissions.
16. Promotional Use
Unless otherwise agreed in writing, TC Creative may request permission to use selected photographs or video footage created during a project for:

TC Creative's website
-
Portfolio
-
Social media
-
Advertising
-
Promotional material
-
Awards and industry submissions
-
Marketing presentations
Where consent is required, TC Creative will obtain the appropriate permission before using identifiable individuals or client-owned material for promotional purposes.
Clients may contact TC Creative if they have specific requirements regarding promotional use.
17. Privacy
TC Creative collects and handles personal information in accordance with its Privacy Policy.
The Privacy Policy explains how personal information, photographs, video footage and other information may be collected, used, stored and disclosed.
By engaging TC Creative, the Client acknowledges that they have had an opportunity to review the Privacy Policy.
18. Third-Party Locations and Venues
The Client is responsible for obtaining any permissions, permits, licences or approvals required by venues, property owners, event organisers or other relevant parties.
TC Creative is not responsible for restrictions imposed by a venue or third party that prevent or limit photography or videography.
Where venue rules require additional fees, permits, insurance or approvals, these may be the responsibility of the Client unless otherwise agreed.
19. Safety
TC Creative reserves the right to stop or refuse photography or videography where conditions are considered unsafe.
This may include situations involving:

Dangerous locations
-
Extreme weather
-
Aggressive behaviour
-
Unsafe equipment
-
Unauthorised access
-
Hazardous environments
-
Threats to TC Creative personnel or equipment
The safety of TC Creative personnel and equipment will take priority over obtaining photographs or video footage.
20. Equipment Failure and Technical Issues
TC Creative uses professional equipment and takes reasonable precautions to protect client material.
However, photography and videography involve technology and equipment that can occasionally fail.
In the unlikely event of equipment failure, data corruption or other technical failure, TC Creative will make reasonable efforts to recover or recreate affected material where possible.
Where a service cannot be provided due to a significant technical failure, TC Creative will determine an appropriate remedy having regard to the circumstances and any rights available to the Client under applicable law.
21. Cancellation and Refunds
Cancellations and refunds are governed by the TC Creative Refund & Cancellation Policy.
The current refund structure is:

More than 90 days before the event: up to a 100% refund, subject to applicable conditions;

90–31 days before the event: 50% refund;
-
30 days or less before the event: no refund.
The Client should review the Refund & Cancellation Policy before making a booking.
Nothing in the Refund & Cancellation Policy or these Terms limits any rights that cannot legally be excluded under the Australian Consumer Law.
22. Force Majeure
TC Creative will not be liable for failure or delay in performing its obligations where the failure or delay is caused by circumstances beyond our reasonable control.
This may include:

Natural disasters
-
Severe weather
-
Fire
-
Flood
-
Government restrictions
-
Venue closures
-
Serious illness or injury
-
Major transport disruption
-
Power or telecommunications failures
-
Public emergencies
-
Civil unrest
-
Acts of terrorism
-
Other circumstances beyond reasonable control
Where reasonably possible, TC Creative will endeavour to reschedule the service or provide an alternative solution.
23. Liability
To the maximum extent permitted by law, TC Creative will not be liable for indirect, incidental or consequential loss arising from the provision of services.
TC Creative's liability will be subject to any limitations or exclusions permitted by applicable law.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded under the Australian Consumer Law.
24. Indemnity
To the extent permitted by law, the Client agrees to indemnify TC Creative against claims, losses, damages, costs or expenses arising from:

The Client's breach of these Terms;

Materials supplied by the Client where the Client does not have the necessary rights or permissions;
-
The Client's failure to obtain required permissions or approvals;
-
Unsafe or unlawful activities requested or facilitated by the Client; or
-
Claims arising from the Client's use of the delivered material outside the agreed licence or permitted use.
This clause does not apply to the extent that the loss was caused by TC Creative's negligence, unlawful conduct or breach of a non-excludable legal obligation.
25. Third-Party Services
TC Creative may use third-party providers in connection with the services, including:

Cloud storage providers
-
File delivery platforms
-
Editing services
-
Music licensing services
-
Equipment suppliers
-
Contractors
-
Payment providers
-
Website providers
-
Other production suppliers
TC Creative will take reasonable steps to work with reputable providers but is not responsible for independent failures of third-party services outside our reasonable control.
26. Client Conduct
TC Creative expects all clients, guests, participants and representatives to behave respectfully and appropriately.
TC Creative reserves the right to cease services where a person engages in threatening, abusive, discriminatory, harassing or unsafe behaviour towards TC Creative personnel.
Where services are ceased due to serious inappropriate conduct, the booking may be treated as a client cancellation and the applicable Refund & Cancellation Policy may apply.
27. Complaints and Disputes
If you have a concern regarding the services provided, you should contact TC Creative as soon as reasonably possible.
We will endeavour to resolve complaints fairly and within a reasonable timeframe.
Where a dispute cannot be resolved directly, either party may seek independent legal advice or pursue any rights available under applicable Australian law.
28. Changes to These Terms
TC Creative may update these Terms from time to time.
The Terms applicable to a booking will generally be those provided to or accepted by the Client at the time the booking is confirmed, unless otherwise required by law.
Any significant changes to an existing booking will be communicated to the Client where reasonably practicable.
29. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the applicable courts and tribunals of New South Wales and Australia in relation to any dispute arising from these Terms, subject to any applicable consumer rights.
30. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or removed to the extent necessary, and the remaining provisions will continue to apply.
31. Entire Agreement
The quotation, booking confirmation, invoice, agreed scope of work, these Terms & Conditions, Refund & Cancellation Policy and Privacy Policy together form the basis of the agreement between TC Creative and the Client, to the extent applicable.
Where there is an inconsistency between documents, the specific written agreement or quotation for the relevant project will generally take precedence, unless otherwise required by law.
