TC Creative (“TC Creative”, “we”, “us” or “our”) provides professional photography and videography services for events, businesses, individuals and other clients.
This Refund & Cancellation Policy outlines the payment, cancellation, rescheduling and refund terms applicable to bookings made with TC Creative.
Nothing in this policy is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law or any other applicable legislation.
1. Payment and Securing Your Booking
Payment must be made in full to secure and confirm your booking with TC Creative.
A booking is not considered confirmed until full payment has been received by TC Creative.
By making full payment, you acknowledge and agree to the terms of this Refund & Cancellation Policy and the agreed scope of services.
Once a booking has been secured, TC Creative may allocate personnel, equipment, resources and time specifically to your event or project and may decline other bookings for the same date.
2. Cancellation and Refunds
If you need to cancel your booking, you must notify TC Creative in writing as soon as possible.
Refunds will be determined according to the amount of notice provided before the event commencement date.
Cancellation More Than 90 Days Before the Event
Where a booking is cancelled more than 90 days before the event commencement date, TC Creative may provide a full refund of the amount paid, subject to any non-refundable costs or expenses already incurred specifically for the booking.
Alternatively, TC Creative may offer the option to transfer the booking to another available date.
Cancellation Between 90 and 31 Days Before the Event
Where a booking is cancelled between 90 and 31 days before the event commencement date, the client may receive a 50% refund of the total amount paid.
The remaining 50% will be retained by TC Creative to account for the reservation of the date, preparation, administration, resources and potential loss of other bookings.
Any non-refundable third-party expenses already incurred specifically for the booking may also be deducted where applicable.
Cancellation Within 30 Days of the Event
No refund will be issued for cancellations made 30 days or less before the event commencement date.
This includes cancellations made:

30 days before the event;
-
14 days before the event;
-
7 days before the event;
-
1 day before the event; or
-
On the event commencement date.
Once a booking reaches the 30-day period before the event, the full amount paid is non-refundable, subject to any rights the client may have under the Australian Consumer Law.
3. Refund Schedule
For clarity, the refund structure is:

*Subject to any applicable non-refundable costs already incurred and any rights available under Australian Consumer Law.
The relevant date is calculated from the event commencement date specified on the booking confirmation.
4. Rescheduling
Clients may request to reschedule their booking by contacting TC Creative as soon as possible.
TC Creative will make reasonable efforts to accommodate a request to reschedule; however, any new date is subject to availability.
Rescheduling a booking does not automatically create an entitlement to a refund.
Where a booking is rescheduled, the original payment may be transferred to the new date at the discretion of TC Creative.
If the requested new date is unavailable, the cancellation and refund terms outlined in this policy will apply.
5. Client Failure to Attend
If a client, event organiser or relevant participant fails to attend or otherwise prevents TC Creative from providing the agreed services, the booking will generally be treated as a cancellation by the client.
No refund will be provided in these circumstances where the cancellation falls within the applicable non-refundable period.
6. Weather and Unforeseen Circumstances
Where severe weather or another unforeseen circumstance makes it unsafe or impractical for TC Creative to provide the agreed services, TC Creative will endeavour to work with the client to reschedule the booking.
Where the booking can reasonably be rescheduled, the original payment may be transferred to the new date.
If rescheduling is not reasonably possible, TC Creative will determine an appropriate outcome having regard to the circumstances, services already performed and costs incurred.
7. Cancellation by TC Creative
In the unlikely event that TC Creative is unable to provide the agreed services due to circumstances within our control, we will endeavour to provide reasonable notice and, where possible, arrange a suitable replacement or alternative date.
If TC Creative is unable to provide the services and no suitable alternative can be arranged, amounts paid for services that cannot be provided may be refunded.
This does not limit any rights you may have under the Australian Consumer Law.
8. Circumstances Beyond Our Control
TC Creative will not be responsible for failure or delay in providing services where this results from circumstances beyond our reasonable control.
This may include, but is not limited to:

Natural disasters

Severe weather
-
Fire or flood
-
Government restrictions
-
Venue closures
-
Serious illness or injury
-
Major transport disruptions
-
Power or telecommunications failures
-
Public emergencies
-
Civil unrest
-
Other circumstances that could not reasonably have been prevented or anticipated
Where such circumstances occur, TC Creative will endeavour to reschedule the booking or provide another reasonable solution.
9. Completed Services
Once the agreed photography or videography services have been performed, no refund will generally be provided because a client subsequently changes their mind about the service, creative style or final result.
Photography and videography are creative services and may involve professional judgement regarding composition, lighting, editing, colour grading, sound, framing and presentation.
Where an agreed revision process applies, TC Creative will consider reasonable revision requests that fall within the original scope of the project.
This does not affect any consumer guarantees or other rights that cannot legally be excluded.
10. Additional Services and Changes
Any services, products or deliverables requested after the original booking has been confirmed may incur additional charges.
Additional work will generally require approval and payment before the additional services are commenced.
Changes to the original scope of work may also affect the delivery timeframe.
11. Third-Party and Non-Refundable Costs
TC Creative may incur expenses in preparation for an event or project.
These may include:

Equipment hire

Additional photographers or videographers
-
Contractors
-
Venue costs
-
Travel and accommodation
-
Permits
-
Production expenses
-
Specialist editing
-
External services
-
Other project-specific costs
Where permitted by law, these costs may be deducted from any refund otherwise available to the client.
12. Digital Files and Deliverables
Once final photographs, videos or other digital deliverables have been supplied to the client, the client is responsible for downloading and securely storing their files.
TC Creative does not guarantee permanent archival storage of client files unless a separate storage or archival service has been agreed in writing.
13. Australian Consumer Law
TC Creative operates in Australia and acknowledges that the Australian Consumer Law (ACL) provides consumers with certain rights and guarantees that cannot be excluded, restricted or modified by a business.
Nothing in this policy is intended to remove or limit those rights.
If a service does not meet the applicable consumer guarantees, you may have rights to a remedy, which may include a refund, replacement, correction or other remedy depending on the circumstances.
Where applicable, statutory rights will take precedence over this Refund & Cancellation Policy.
14. Refund Processing
Where TC Creative agrees to provide a refund, the refund will generally be processed using the original payment method.
Processing times may vary depending on the payment provider or financial institution.
TC Creative is not responsible for delays caused by third-party payment providers.
15. How to Request a Cancellation or Refund
All cancellation and refund requests must be made in writing and submitted to TC Creative as soon as possible.
Requests should include:

Any relevant supporting information
TC Creative will review the request and confirm the applicable refund amount in accordance with this policy.
16. Changes to This Policy
TC Creative reserves the right to update this Refund & Cancellation Policy from time to time.
The version published on the TC Creative website will represent the current policy.
Bookings may remain subject to the terms and conditions agreed at the time the booking was made, unless otherwise required by law.
